Introduction

Welcome to Quash, a product offered by Brisk Labs. These Terms of Service (“Terms”) apply to the use of Quash, an innovative tool designed to streamline the bug-reporting process during app testing. By incorporating Quash into your application, you empower your QA teams and testers to report bugs seamlessly from the test build. This includes the ability to attach media like screenshots and videos and conveniently send them to platforms such as JIRA. Your use of Quash is subject to your acceptance of these Terms. Please read these terms carefully.

Privacy

Your use of Quash may involve the collection of data. Please refer to our Privacy Policy for information on our data collection practices and how we handle your data. This policy is available on the dedicated Privacy Policy page.

Electronic Communications

Using Quash entails electronic communications. You consent to receive electronic communications, and you acknowledge that all agreements, notices, disclosures, and other communications provided to you electronically, whether via email or on the site, satisfy the legal requirement that such communications be in writing.

Your Account

Should you decide to use our services, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. You may not assign or otherwise transfer your account to any other entity. Be aware that Quash will not be responsible for third party access to your account resulting from theft or misappropriation. Quash reserves the right to refuse or cancel service, terminate accounts, or edit or remove content in our sole discretion.

Children under the Age of 13

Quash does not knowingly collect personal information from individuals under the age of thirteen, whether online or offline. If you are under 18, you may use Quash only with the permission of a parent or guardian.

Links to Third-Party Sites or Services

Quash may enable you to connect your account to third-party platforms or services. Certain services made available through Quash are provided by third-party sites and organizations. By using any product, service, or functionality originating from the Quash domain, you acknowledge and consent to the sharing of relevant information with any third party with which Quash has a contractual relationship to provide requested products, services, or functionality on behalf of Quash users and customers.

By connecting your Quash account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others in accordance with your privacy settings on those third-party platforms. If you do not wish to share information about yourself, including personally identifying information, in this manner, we advise against using this feature. You may disconnect your account from a third-party platform at any time using the integrations page in your workspace.

Third-Party Accounts

You have the option to connect your Quash account to third-party accounts. By establishing this connection, you acknowledge and agree that you are consenting to the continuous release of information about you to others, as defined by your privacy settings on those third-party platforms. If you are uncomfortable with the idea of sharing information about yourself in this manner, we recommend refraining from using this feature.

Third-Party Connections Disclosures

Quash use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Quash provides the option to send bug reports directly to JIRA or other compatible platforms. By using this feature, you agree to comply with the terms and conditions of JIRA or the chosen platform.

Source References and Linked Sites

Quash, while interacting, may contain references to the sources ingested by workspace owners. These references may appear as links to other websites, referred to as “Linked Sites.” These Linked Sites are not under the control of Quash, and we are not responsible for the content of any Linked Site, including any links contained within a Linked Site or any changes or updates to a Linked Site. Quash provides these links for your convenience, and their inclusion does not imply endorsement by Quash or any association with the operators of those sites.

No Unlawful or Prohibited Use and Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use Quash strictly in accordance with these terms of use. As a condition of your use of the site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner that could damage, disable, overburden, or impair it or interfere with the use and enjoyment of the Site by any other party. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Quash or its suppliers. It is protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content and will not make any changes thereto. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Quash content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Quash and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Quash or our licensors except as expressly authorized by these Terms.

Use of Communication Services

Quash provides various communication services, such as bulletin boards, chat areas, forums, and more (collectively, “Communication Services”), to facilitate user interaction. To ensure responsible and respectful use of these services, you agree to the following guidelines:

Do not engage in defamatory, abusive, harassing, stalking, threatening, or any other behaviour that violates the legal rights (e.g., privacy and publicity) of others.
Do not publish, post, upload, distribute, or disseminate inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content.
Do not upload files containing software or materials protected by intellectual property laws or rights of privacy unless you own the rights or have obtained necessary consent.
Do not upload files that may contain viruses, corrupted files, or other harmful software.
Do not use the Communication Services for advertising, selling, or buying goods or services unless explicitly permitted.
Do not conduct surveys, contests, pyramid schemes, or chain letters.
Do not download files posted by another user if you know, or should reasonably know, they cannot be legally distributed.
Do not falsify or delete author attributions, legal notices, or proprietary designations.
Do not restrict or inhibit other users from enjoying the Communication Services.
Comply with any specific codes of conduct or guidelines for each Communication Service.
Do not harvest or collect information about others, including email addresses, without their consent.
Do not violate any applicable laws or regulations.

While Quash is not obligated to monitor the Communication Services, we reserve the right to review and remove materials at our discretion. Quash also reserves the right to terminate your access to these services at any time and to disclose information to comply with legal requirements.

Please exercise caution when sharing personally identifying information in any Communication Service. Quash does not control or endorse the content and actions in these services and disclaims liability for any consequences of your participation in them.

Materials Provided to Quash

When you provide materials to Quash, including feedback and suggestions, or post, upload, input, or submit materials to any Quash platform or service (collectively, “Submissions”), you retain ownership of these materials. However, by providing or submitting your Submissions, you grant Quash, our affiliated companies, and necessary sublicensees permission to use your Submissions for their internet business operations. This usage includes the right to copy, distribute, transmit, display, perform, reproduce, edit, translate, and reformat your Submissions. Quash may also publish your name in connection with your Submission. No compensation will be paid for the use of your Submission.

Quash is not obligated to post or use any Submission, and we may remove Submissions at any time at our sole discretion. By submitting your materials, you warrant and represent that you own or control all the rights to your Submissions as described in this section, including all rights necessary for providing, posting, uploading, inputting, or submitting the Submissions.

Indemnification

You agree to indemnify, defend, and hold harmless Quash, its officers, directors, employees, agents, and third parties, from any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) related to or arising from your use of the Quash site or services, any user postings made by you, your violation of any terms in this Agreement, your violation of the rights of a third party, or your violation of any applicable laws, rules, or regulations. Quash reserves the right, at its own cost, to assume the exclusive defence and control of any matter subject to indemnification, and you must cooperate fully with Quash in asserting any available defences.

Arbitration

In the event of a dispute arising from or concerning these Terms and Conditions, or any provisions therein, the parties shall resolve the dispute through final and binding arbitration, as governed by the Indian Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a single neutral arbitrator, administered by an arbitration service chosen by the parties and compliant with Indian laws. The parties agree to arbitrate all disputes, whether directly or indirectly related to these Terms and Conditions, including Tort claims. The arbitrator’s award will be final, and judgment may be entered in any court with jurisdiction in India.

This amendment aligns the arbitration process with Indian regulations and legal procedures.

Class Action Waiver

Arbitration under these Terms and Conditions will occur on an individual basis, and class arbitrations or class/representative/collective actions are not permitted. The parties agree that claims can only be brought in an individual capacity and not as part of any class, collective, or representative action. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims or preside over any representative or class proceeding.

Liability Disclaimer

The information, software, products, and services provided on the Quash site may contain inaccuracies or typographical errors. Quash and its suppliers may make improvements and changes to the site at any time. Quash and its suppliers make no representations regarding the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. Quash and its suppliers disclaim all warranties and conditions, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In no event shall Quash or its suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including but not limited to damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the site or related services, the delay or inability to use the site or services, the provision or failure to provide services, or for any information, software, products, services, and related graphics obtained through the site, or otherwise arising from site use, whether based on contract, tort, negligence, strict liability, or otherwise, even if Quash or its suppliers have been advised of the possibility of damages. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. If you are dissatisfied with any portion of the site or these Terms of Use, your sole and exclusive remedy is to discontinue using the site.

Termination or Access Restriction

Quash reserves the right to terminate your access to the site and related services, in its sole discretion, without notice. This agreement is governed by the laws of India. You consent to the exclusive jurisdiction and venue of the courts in Bangalore in disputes related to the use of the site. If any part of this agreement is determined to be invalid or unenforceable, the invalid provision will be replaced with a valid, enforceable provision that aligns with the original intent, and the remainder of the agreement will remain in effect. This agreement constitutes the entire agreement between you and Quash and supersedes all previous communications and proposals.

Changes to Terms

Quash reserves the right to change the Terms under which it is offered. The most current version of the Terms will supersede previous versions.
